These Terms and Conditions ("Agreement") govern all services provided by Chimney Sweep San Antonio, Inc ("Company," "we," or "us") to the customer ("Client"). By engaging our services, the Client acknowledges and agrees to the terms set forth below. Please read this Agreement carefully.

1. Services Provided

The Company agrees to provide professional chimney sweeping, inspection, and related maintenance services as explicitly requested by the Client and confirmed in writing or via electronic communication. Services may include, but are not limited to, removal of soot and creosote, level 1 and level 2 inspections, and minor repairs. Any additional work not specified in the initial scope must be approved by the Client prior to commencement and will be billed separately.

2. Payment Terms

  • Quotes and Estimates: All quotes are valid for 30 days from the date of issuance. Final pricing may vary if the condition of the chimney or fireplace differs materially from the initial assessment.
  • Due Date: Payment is due in full upon completion of the services, unless a written credit arrangement has been established prior to the service date.
  • Accepted Methods: We accept cash, credit card, and electronic bank transfer. A service fee of 3% applies to all credit card transactions.
  • Late Payments: Any undisputed amount not paid within 15 days of the invoice date will accrue interest at the rate of 1.5% per month, or the maximum rate permitted by law, whichever is lower. The Client agrees to pay all reasonable collection costs and attorney fees incurred by the Company in collecting overdue amounts.

3. Liability Limitations

  • Limitation of Liability: To the fullest extent permitted by law, the Company's total liability to the Client for any claim, loss, or damage arising out of or related to this Agreement shall be limited to the total amount paid by the Client for the specific service rendered.
  • Consequential Damages: The Company shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of property, loss of use, or loss of profits, even if advised of the possibility of such damages.
  • Pre-Existing Conditions: The Company is not responsible for damage to flues, liners, or masonry that is discovered during service and was pre-existing or caused by prior use, weather, or structural settlement. The Client will be notified of any such findings.
  • Force Majeure: The Company shall not be liable for delays or failure to perform due to circumstances beyond its reasonable control, including acts of God, severe weather, labor disputes, or supply chain interruptions.

4. Client Responsibilities

The Client agrees to provide safe and reasonable access to the chimney, fireplace, and related equipment. The Client must disclose any known prior damage, modifications, or unusual conditions. The Client is responsible for securing pets and ensuring the work area is clear of personal belongings. Failure to provide access may result in rescheduling fees.

5. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state or federal courts located in Bexar County, Texas. The parties agree to attempt in good faith to resolve any dispute through informal negotiation for a period of 30 days before initiating formal legal proceedings.
